Information clause for the processing of job candidates’ personal data
Select the country to which the recruitment (internship program) you are taking part applies: Georgia. iTechArt LLC is obliged to protect the personal data made available or entrusted to it. We process personal data in accordance with the laws in force in Georgia. This information clause explains who we are, what personal data we process, for what purposes and how long we store the data, how you can access the data, how we protect your data, where the data can be transferred and what your rights are in this regard.
I. Who is the controller of your personal data?
iTechArt LLC with its registered office in Tbilisi, 12 Merab Aleksidze St., floor 3, office space No.24a, Tbilisi, Georgia is the Controller of a personal data within the meaning of Law of Georgia on Personal Data Protection of 28 December 2011 No. 5669 (“Data Protection Law”), hereinafter referred to as “Vention” and, together with its affiliates, as the “Vention Group”. II. What types of personal data do we process?
Vention may obtain information from you concerning your job application for employment or cooperation with Vention. Pursuant to Organic Law of Georgia - the Labour Code of Georgia, such information includes:
- name(s) and surname
- date of birth
- contact data indicated by the candidate
- education
- professional qualifications
- employment history
In the case of foreigners – also data required by law and resulting from documents necessary to verify the legality of employment or to carry out the employment legalization procedure. We can also process other data provided to us by you, e.g. image. You may, on your own initiative, want to provide us with additional information (in a CV, cover letter or in a similar document). If this is the case, your personal data will be processed by Vention for the purpose of concluding an employment (internship) agreement. Therefore, if you want to provide us with documents containing additional information, we understand that by submitting the application you agree to have your personal data processed by Vention. You are not obliged to provide us with additional information. If you do not want us to process more of your personal data than required under the law, please do not include such information in the CV you send.
III. How is your personal data obtained?
In the course of our recruitment process we collect personal data of our candidates. Personal data is obtained in two ways:
- directly from candidates (including through recruitment portals websites etc.) or
- from third parties, in particular: a) from the Vention Group resources; b) from the Ventions’ employees and contractors, with your prior consent, as part of our internal or external referral program; c) from public data sources, such as Linkedin; d) from recruitment agencies, labour agencies, intermediaries, and service providers (if applicable)
IV. On what basis do we process your personal data?
Your personal data will be processed for purposes related to recruitment for the selected position:
- in the case of candidates for employment under an employment contract within the scope specified in Labour Code of Georgia
- in the case of candidates for employment under a civil law contract, to the extent necessary to take action at the request of the data subject before concluding the contract, pursuant to the Civil Code of Georgia
- in the case of employing a foreigner – in addition to the purposes indicated above, also for the purpose of verifying the legality of employment, in order to carry out the procedure of legalization of employment
- if we have obtained your data from publicly available sources – in order to conduct and settle the recruitment process with your participation (then the legal basis for the processing of your data is the legitimate interest
- in the remaining scope, the data will be processed on the basis of the Candidate's consent expressed by an express confirmatory action consisting in including this data in the application
- data may also be processed on the basis of the Controller's legitimate interest, after the completion of the recruitment process in order to establish, pursue or defend against possible claims related to it
If you consent to processing your personal data for the purpose of future recruitment possibilities, the data will be processed on the basis of your consent to such processing.
V. What is the purpose of our processing of your data?
Your information is always treated as confidential and used solely for the purpose of assessing the application submitted by you, providing you with information on the recruitment procedures, processing the application to carry out the recruitment process and taking steps at your request prior to entering into a contract including on the basis of your consent for future recruitment processes. We may also process your personal data for internal reporting and development reasons- this is necessary due to the Controllers’ legitimate interests in tracking recruitment and managing an external and internal talent pool, which do not override your interests or fundamental rights and freedoms requiring the protection of personal data.
VI. What are the consequences of non-provision of your data?
Your provision of data is voluntary, yet necessary to participate in the recruitment process, to meet further legal requirements and/or to enter into a contract with us. Failure to provide us with the required information will render participation in the recruitment process and/or sending information related to the future recruitment process impossible.
VII. How long do we store your personal data?
Vention stores your personal data for as long as this is required under applicable laws or for as long as the processing of personal data is necessary for the purposes set forth in this Information Clause. Vention keeps the data provided by you via the recruitment service for the duration of the recruitment process solely for the purpose of carrying out the process and in order to comply with the data recording requirements imposed by applicable laws. If you want us to keep your documents in our job applicant database for a longer period (including for future recruitment processes and sending recruitment newsletter), your consent will be required, and your personal data will be processed for the period of 2 years.
VIII. Who will receive your personal data?
Vention makes personal data available to third parties in line with applicable laws. Your personal data is processed solely for the purposes referred to herein or for closely related purposes. Once you have given the relevant consent, personal data may be used for future recruitment processes and also be transferred to affiliated entities within the Vention Group network. Vention can share candidate’s personal data with:
- other entities in the Vention Group, including entities established in countries outside the European Economic Area
- service providers, customers
- entities located in third countries, outside the territory of the European Economic Area
Vention will ensure that the transfer of personal data to a third country is carried out in accordance with the requirements of the Data Protection Law. You can at any time request details about the entities to which your personal data has been made available and the scope of information about you which has been made available, by contacting us by sending a message to privacy.ge@ventionteams.com. Entities located in third countries will ensure the security of personal data at a level not lower than the level of safeguards applied by Vention.
IX. What are your rights?
As a job applicant, you have the right to:
- request access to your personal data held by Vention
- request rectification and erasure of the data
- request limitation of its processing
- data portability
- object to its processing
- obtain a copy of data transferred to third countries
In order to exercise the rights, please contact us by sending a message to: privacy.ge@ventionteams.com. If data is processed on the basis of your consent, you may withdraw your consent at any time. If you withdraw the consent, this will not affect the lawfulness of processing based on consent before its withdrawal. If the personal data processing violates the privacy and information security regulations, you also have the right to lodge a complaint with a supervisory authority, that is the President of the Personal Data Protection Service. These rights may be limited if the fulfilment of your request would disclose data about another person or if you have asked us to remove the information which is required by law or where retaining the information is necessary on the grounds of legitimate interests of the Controller.
X. Security of your personal data
Vention uses technical, physical and organizational security measures to prevent the risk of loss, misuse, disclosure or modification of information provided by you, as well as the risk of unauthorized access to such information.

XII. Consent
The job applicant, using a specific recruitment service to take part in the recruitment conducted by Vention, agrees to the processing of his/her personal data by performing an explicit confirming action (e.g. by sending his/her CV and/or by completing the form with his/her personal data). The provision of data in this way via the recruitment service is tantamount to consent to the collection, processing, use, storage and transfer of the user’s personal data by Vention in a manner specified in the Notice. By sending the application documents, you also agree to the electronic handling of all issues relating to the recruitment, application, identity verification and onboarding process.
IF YOU DO NOT CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL DATA AS INDICATED ABOVE, YOU CANNOT TAKE PART IN THE RECRUITMENT.
საინფორმაციო თანხმობა სამუშაოს კანდიდატების პერსონალური მონაცემების დამუშავებასთან დაკავშირებით
აირჩიეთ ქვეყანა, სადაც ტარდება რეკრუტირება (სტაჟირების პროგრამა), რომელშიც მონაწილეობთ: საქართველო. შპს iTechArt („ვენტიონ”) მოწოდებულია დაიცვას ჩვენთვის მოწოდებული ან მინდობილი პერსონალური მონაცემები. ჩვენ ვამუშავებთ პერსონალურ მონაცემებს საქართველოში მოქმედი კანონების შესაბამისად. ამ ინფორმაციის უარყოფა განმარტავს ვინ ვართ ჩვენ, რა პერსონალურ მონაცემებს ვამუშავებთ, რა მიზნებისთვის და რამდენ ხანს ვინახავთ ამ მონაცემებს, როგორ შეგიძლიათ ამ მონაცემებზე წვდომა, როგორ ვიცავთ თქვენს მონაცემებს, სად შეიძლება გადავიდეს ეს მონაცემები და რა უფლებები გაქვთ ამასთან დაკავშირებით.
I. ვინ არის თქვენი პერსონალური მონაცემების მაკონტროლებელი?
შპს აიტექარტი, რეგისტრირებული მისამართზე: თბილისი, მერაბა ალექსიძის ქ . 12, მე-3 სართული, საოფისე ფართი №24ა, საქართველო, არის პერსონალური მონაცემების მაკონტროლებელი „პერსონალურ მონაცემთა დაცვის შესახებ“ საქართველოს 2011 წლის 28 დეკემბრის კანონის შესაბამისად. No5669 („მონაცემთა დაცვის კანონი“), შემდგომში „ვენტიონ“ და მის ფილიალებთან ერთად - „ვენტიონ ჯგუფი“. თუ თქვენ გაქვთ რაიმე შეკითხვები პერსონალური მონაცემების დამუშავებასთან დაკავშირებით, შეგიძლიათ დაგვიკავშირდეთ შეტყობინების გაგზავნით შემდეგ მისამართზე: privacy.ge@ventionteams.com.
II. რა ტიპის პერსონალურ მონაცემებს ვამუშავებთ?
Vention-მა შესაძლოა მიიღოს თქვენგან ინფორმაცია დასაქმების ან Vention-ში დასაქმების განაცხადთან დაკავშირებით. საქართველოს ორგანული კანონის - საქართველოს შრომის კოდექსის შესაბამისად, ასეთი ინფორმაცია მოიცავს:

- Დაბადების თარიღი
- კანდიდატის მიერ მოწოდებული საკონტაქტო ინფორმაცია
- განათლება
- პროფესიონალური კვალიფიკაცია
- ინფორმაცია სამუშაო საქმიანობის შესახებ
უცხო ქვეყნის მოქალაქეების შემთხვევაში - ასევე კანონით მოთხოვნილი და დასაქმების კანონიერების დასადასტურებლად ან ლეგალიზაციისა და დასაქმების პროცედურის განსახორციელებლად აუცილებელი დოკუმენტებით გათვალისწინებული მონაცემები. ჩვენ ასევე შეიძლება დავამუშავოთ ჩვენთვის მოწოდებული სხვა მონაცემები, როგორიცაა სურათები. თქვენ შეგიძლიათ თქვენი ინიციატივით მოგვაწოდოთ დამატებითი ინფორმაცია (თქვენს რეზიუმეში, სამოტივაციო წერილში ან სხვა მსგავს დოკუმენტში). ამ შემთხვევაში თქვენი პერსონალური მონაცემები დამუშავდება Vention-ის მიერ შრომითი ხელშეკრულების (სტაჟირების ხელშეკრულება) დადების მიზნით. ამიტომ, თუ გსურთ მოგვაწოდოთ დამატებითი ინფორმაციის შემცველი დოკუმენტები, ჩვენ გვესმის, რომ განაცხადის წარდგენით თქვენ ეთანხმებით Vention-ის მიერ თქვენი პერსონალური მონაცემების დამუშავებას. თქვენ არ ხართ ვალდებული მოგვაწოდოთ დამატებითი ინფორმაცია. თუ არ გსურთ თქვენი პერსონალური მონაცემების დამუშავება იმაზე მეტი, ვიდრე კანონით არის მოთხოვნილი, გთხოვთ, არ შეიტანოთ ასეთი ინფორმაცია თქვენს მიერ წარდგენილ CV-ში .
III. როგორ მივიღოთ თქვენი პირადი მონაცემები?
დაქირავების პროცესში ჩვენ ვაგროვებთ პერსონალურ ინფორმაციას ჩვენი კანდიდატებისგან. პერსონალური მონაცემები მიიღება ორი გზით:
- უშუალოდ კანდიდატებისგან (მათ შორის, დასაქმების პორტალების, ვებსაიტების და ა.შ.) ან
- მესამე მხარისგან, კერძოდ: a) Vention Group-ის რესურსებიდან; b) Vention-ის თანამშრომლებისა და კონტრაქტორებისგან, თქვენი წინასწარი თანხმობით, როგორც ჩვენი შიდა ან გარე რეფერალური პროგრამის ნაწილი; c) ღია მონაცემთა წყაროებიდან, როგორიცაა Linkedin; d) დასაქმების სააგენტოებიდან, დასაქმების სააგენტოებიდან, შუამავლებისგან და მომსახურების მიმწოდებლებისგან (ასეთის არსებობის შემთხვევაში).
IV. რის საფუძველზე ვამუშავებთ თქვენს პერსონალურ მონაცემებს?
თქვენი პერსონალური მონაცემები დამუშავდება არჩეულ თანამდებობაზე დასაქმებასთან დაკავშირებული მიზნებისთვის:
- შრომითი ხელშეკრულებით სამუშაოზე პრეტენდენტების შემთხვევაში – საქართველოს შრომის კოდექსით განსაზღვრულ ფარგლებში
- სამოქალაქო ხელშეკრულებით სამუშაოზე პრეტენდენტების შემთხვევაში – იმდენად, რამდენადაც ეს აუცილებელია ხელშეკრულების დადებამდე მონაცემთა სუბიექტის მოთხოვნით და საქართველოს სამოქალაქო კოდექსის შესაბამისად
- უცხოელის აყვანის შემთხვევაში - ზემოაღნიშნული მიზნების გარდა, ასევე დასაქმების კანონიერების შემოწმება, ლეგალიზაციისა და დასაქმების პროცედურების განხორციელება
- თუ ჩვენ მოვიპოვეთ თქვენი მონაცემები საჯაროდ ხელმისაწვდომი წყაროებიდან - თქვენი მონაწილეობით დაქირავების პროცესის განსახორციელებლად და დასასრულებლად (მაშინ მონაცემთა დამუშავების სამართლებრივი საფუძველი არის კანონიერი ინტერესი)
- სხვა შემთხვევაში მონაცემები დამუშავდება კანდიდატის თანხმობის საფუძველზე, რაც გამოიხატება აშკარა დამადასტურებელი მოქმედებით, რომელიც შედგება ამ მონაცემების განაცხადში შეტანისგან
- მონაცემები ასევე შეიძლება დამუშავდეს კონტროლერის კანონიერი ინტერესებიდან გამომდინარე, რეკრუტირების პროცესის დასრულების შემდეგ, პრეტენზიის დასაბუთების, წარდგენის ან მასთან დაკავშირებული შესაძლო პრეტენზიებისგან დაცვის მიზნით
მომავალი დასაქმების შესაძლებლობების შექმნის მიზნით , მონაცემები დამუშავდება ამ დამუშავებაზე თქვენი თანხმობის საფუძველზე .
V. რა მიზნით ვამუშავებთ თქვენს მონაცემებს?
თქვენი ინფორმაცია ყოველთვის განიხილება, როგორც კონფიდენციალური და გამოიყენება მხოლოდ თქვენი განაცხადის შეფასების, დაქირავების პროცედურების შესახებ ინფორმაციის მოწოდებისთვის, თქვენი განაცხადის დასაქმების პროცესში და თქვენი მოთხოვნით ხელშეკრულების დადებამდე ნაბიჯების გადადგმის მიზნით, თქვენი თანხმობის ჩათვლით. სამომავლო რეკრუტირების პროცესებზე . ჩვენ ასევე შეიძლება დავამუშავოთ თქვენი პერსონალური მონაცემები შიდა მოხსენებისა და განვითარების მიზნებისთვის. ეს აუცილებელია კონტროლერების ლეგიტიმური ინტერესებიდან გამომდინარე დაკომპლექტების პროცესის მონიტორინგში და მაღალკვალიფიციური სპეციალისტების გარე და შიდა ფონდის მართვაში, რომლებიც არ აჭარბებენ თქვენს ინტერესებს ან ფუნდამენტურ უფლებებსა და თავისუფლებებს, რომლებიც საჭიროებენ პერსონალური მონაცემების დაცვას.
VI. რა შედეგები მოჰყვება თქვენს მიერ მონაცემების წარუმატებლობას?
თქვენ ნებაყოფლობით აწვდით მონაცემებს, მაგრამ აუცილებელია დაქირავების პროცესში მონაწილეობა, სამართლებრივი მოთხოვნების დაცვა ან/და ჩვენთან ხელშეკრულების გაფორმება. თუ არ მოგვაწოდებთ საჭირო ინფორმაციას, შესაძლოა ვერ შეძლოთ დაქირავების პროცესში მონაწილეობა და/ან წარადგინოთ ინფორმაცია მომავალ დაქირავების პროცესთან დაკავშირებით.
VII. რამდენ ხანს ვინახავთ თქვენს პერსონალურ მონაცემებს?
Vention ინახავს თქვენს პერსონალურ მონაცემებს მანამ, სანამ ამას მოითხოვს მოქმედი კანონმდებლობა ან სანამ პერსონალური მონაცემების დამუშავება აუცილებელია ამ პასუხისმგებლობის შეზღუდვის მიზნებისათვის. Vention ინახავს თქვენს მიერ მოწოდებულ მონაცემებს დაქირავების სამსახურის მეშვეობით დაქირავების პროცესის განმავლობაში მხოლოდ ამ პროცესის დასრულების და მოქმედი კანონმდებლობით მოთხოვნილი მონაცემთა ჩაწერის მოთხოვნების შესასრულებლად. თუ გსურთ, რომ თქვენი დოკუმენტები უფრო მეტხანს შევინახოთ სამუშაოს განმცხადებლების მონაცემთა ბაზაში (მათ შორის, დასაქმების შემდგომი პროცესებისთვის და დასაქმების გაზეთებისთვის), საჭირო იქნება თქვენი თანხმობა. ამ შემთხვევაში თქვენი პერსონალური მონაცემები დამუშავდება 2 წლის განმავლობაში .
VIII. ვინ მიიღებს თქვენს პირად მონაცემებს?
Vention უზრუნველყოფს პერსონალურ მონაცემებს მესამე პირებს მოქმედი კანონმდებლობის შესაბამისად. თქვენი პერსონალური მონაცემები მუშავდება მხოლოდ ამ დოკუმენტში მითითებული მიზნებისთვის ან მათთან მჭიდროდ დაკავშირებული მიზნებისთვის. შესაბამისი თანხმობის მიღების შემდეგ, პერსონალური მონაცემები შეიძლება გამოყენებულ იქნეს შემდგომი დაქირავების პროცესებისთვის და ასევე შეიძლება გაზიარებული იყოს Vention Group-ის ქსელში მყოფ ფილიალებთან. Vention-მა შეიძლება გააზიაროს კანდიდატების პირადი მონაცემები:
- Vention Group-ის სხვა კომპანიები, მათ შორის კომპანიები, რომლებიც დაარსებულნი არიან ევროპის ეკონომიკური ზონის მიღმა მყოფ ქვეყნებში
- მომსახურების მიმწოდებლები, კლიენტები
- კომპანიები, რომლებიც მდებარეობს მესამე ქვეყნებში ევროპის ეკონომიკური ზონის გარეთ
Vention უზრუნველყოფს, რომ პერსონალური მონაცემების მესამე ქვეყანაში გადაცემა განხორციელდება მონაცემთა დაცვის კანონის მოთხოვნების შესაბამისად. თქვენ შეგიძლიათ ნებისმიერ დროს მოითხოვოთ იმ კომპანიების დეტალები, რომლებთანაც თქვენი პირადი ინფორმაცია იყო გაზიარებული და თქვენს შესახებ გაზიარებული ინფორმაციის მოცულობა, დაგვიკავშირდით privacy.ge@ventionteams.com. მესამე ქვეყნებში მდებარე კომპანიები იღებენ ვალდებულებას უზრუნველყონ პერსონალური მონაცემების დაცვა არანაკლებ დონეზე, ვიდრე Vention-ის მიერ გამოყენებული დაცვის დონე.
IX. რა უფლებები გაქვთ?
როგორც სამუშაოს განმცხადებელს უფლება გაქვთ:
- მოითხოვეთ წვდომა თქვენს პერსონალურ მონაცემებზე, რომელსაც ფლობს Vention
- მოითხოვოს მონაცემების შესწორება და წაშლა
- მოითხოვოს მათი დამუშავების შეზღუდვა
- მონაცემთა პორტაბელურობა
- მათი დამუშავების წინააღმდეგი
- მიიღეთ მესამე ქვეყნებში გადაცემული მონაცემების ასლი
ამ უფლებების გამოსაყენებლად გთხოვთ დაგვიკავშირდეთ ელექტრონული ფოსტის გაგზავნით შემდეგ მისამართზე: privacy.ge@ventionteams.com. თქვენი თანხმობის საფუძველზე, შეგიძლიათ ნებისმიერ დროს გააუქმოთ თქვენი თანხმობა. თუ თქვენ გააუქმებთ თანხმობას, ეს არ იმოქმედებს თანხმობის საფუძველზე დამუშავების კანონიერებაზე მის გაუქმებამდე . თუ პერსონალური მონაცემების დამუშავება არღვევს კონფიდენციალურობისა და ინფორმაციის უსაფრთხოების მარეგულირებელ მოთხოვნებს, თქვენ ასევე გაქვთ უფლება მიმართოთ საჩივარი ზედამხედველობის ორგანოს, ანუ პერსონალურ მონაცემთა დაცვის სამსახურის ხელმძღვანელს. ეს უფლებები შეიძლება შეიზღუდოს, თუ თქვენი მოთხოვნის შესრულება გამოიწვევს სხვა პირის შესახებ მონაცემებს, ან თუ თქვენ გვთხოვეთ წაშალოთ ინფორმაცია, რომელიც კანონით არის მოთხოვნილი, ან თუ ინფორმაციის შენახვა აუცილებელია კონტროლერის ლეგიტიმური ინტერესებიდან გამომდინარე.
X. პირადი მონაცემების უსაფრთხოება
Vention იყენებს ტექნიკურ, ფიზიკურ და ორგანიზაციულ უსაფრთხოების ზომებს, რათა თავიდან აიცილოს თქვენ მიერ მოწოდებული ინფორმაციის დაკარგვის, ბოროტად გამოყენების, გამჟღავნების ან შეცვლის რისკი, ასევე ასეთ ინფორმაციაზე არაავტორიზებული წვდომის რისკი.
XI. როგორ შეგიძლიათ დაგვიკავშირდეთ?
თუ თქვენ გაქვთ შეკითხვები, პრობლემები ან პრეტენზიები პერსონალური მონაცემების დამუშავებასთან დაკავშირებით, შეგიძლიათ დაგვიკავშირდეთ მისამართზე: privacy.ge@ventionteams.com.
XII. Შეთანხმება
სამუშაოს განმცხადებელი, რომელიც იყენებს კონკრეტულ დაქირავების სერვისს Vention-ის დაქირავების პროცესში მონაწილეობის მისაღებად, თანხმდება მათი პერსონალური მონაცემების დამუშავებაზე მკაფიო დადებითი ქმედებით (მაგალითად, CV-ის გაგზავნით და/ან პერსონალური მონაცემებით ფორმის შევსებით). რეკრუტირების სამსახურის მეშვეობით მონაცემების ამ გზით მიწოდება წარმოადგენს მომხმარებლის თანხმობას Vention-ის მიერ პერსონალური მონაცემების შეგროვებაზე, დამუშავებაზე, გამოყენებაზე, შენახვაზე და გადაცემაზე შეტყობინებაში მითითებული წესით. თქვენი განაცხადის დოკუმენტების წარდგენით, თქვენ ასევე ეთანხმებით ყველა იმ საკითხს, რომელიც დაკავშირებულია დაქირავებასთან, განაცხადთან, პირადობის გადამოწმებასთან და დასაქმების პროცესთან ელექტრონულ დამუშავებაზე.
თუ არ ეთანხმებით თქვენი პერსონალური ინფორმაციის შეგროვებას, გამოყენებას და გამჟღავნებას, როგორც ეს ზემოთ არის მითითებული, თქვენ არ შეგიძლიათ მონაწილეობა მიიღოთ დაქირავების პროცესში.
