Information clause for the processing of job candidates' personal data

 

Select the country to which the recruitment (internship program) you are taking part applies: Lithuania. Vention Development UAB with its registered office in Vilnius is obliged to protect the personal data made available or entrusted to it.  We process personal data in accordance with the laws in force in the Republic of Lithuania. This information clause explains who we are, what personal data we process, for what purposes and how long we store the data, how you can access the data, how we protect your data, where the data can be transferred and what your rights are in this regard. 

 

I. Who is the controller of your personal data? 

Vention Development UAB with its registered office in Vilnius (LT-09320), at Lvivo str. 25-104, the Republic of Lithuania is the Controller of a personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as the “GDPR"), hereinafter referred to as “Vention” and, together with its affiliates, as the “Vention Group”. II. What types of personal data do we process? 

Vention may obtain information from you concerning your job application for employment or cooperation with Vention. We process the data necessary to conduct and settle the recruitment process with your participation and necessary to conclude an employment contract / civil law contract with you, such as:  

 

• name(s) and surname
• date of birth
• contact data indicated by the candidate
• education
• professional qualifications
• employment history  

In the case of foreigners – also data required by law and resulting from documents necessary to verify the legality of employment or to carry out the employment legalization procedure. We can also process other data provided to us by you, e.g. image. You may, on your own initiative, want to provide us with additional information (in a CV, cover letter or in a similar document). If this is the case, your personal data will be processed by Vention for the purpose of concluding an employment (internship) agreement. Therefore, if you want to provide us with documents containing additional information, we understand that by submitting the application you agree to have your personal data processed by Vention. You are not obliged to provide us with additional information. If you do not want us to process more of your personal data than required under the law, please do not include such information in the CV you send. 

III. How is your personal data obtained? 

In the course of our recruitment process we collect personal data of our candidates. Personal data is obtained in two ways:  

 

• directly from candidates (including through the Ventions’ website, work related websites such as linkedin.com, other Internet platforms, etc.) or  
• from third parties, in particular:  a) From the Vention Group resources; b) From the Ventions’ employees and contractors, with your prior consent, as part of our internal or external referral program; c) From public data sources, such as Linkedin; d) From recruitment agencies, labour agencies, intermediaries, and service providers (if applicable)

IV. On what basis do we process your personal data? 

Your personal data will be processed for purposes related to recruitment for the selected position: 

 

• in the case of candidates for employment under an employment contract within the scope specified in the Labour Code and to take steps at your request prior to entering into an employment contract, pursuant to Article 6 section 1 letter b of the GDPR
• in the case of candidates for employment under a civil law contract, to the extent necessary to take action at the request of the data subject before concluding the contract, pursuant to Art. 6 section 1 letter b GDPR
• in the case of employing a foreigner – in addition to the purposes indicated above, also for the purpose of verifying the legality of employment, pursuant to Article 6 section 1 letter c) of the GDPR or in order to carry out the procedure of legalization of employment, pursuant to Article 6 section 1 letter b) of the GDPR
• if we have obtained your data from publicly available sources – in order to conduct and settle the recruitment process with your participation (then the legal basis for the processing of your data is the legitimate interest pursued on the basis of Article 6 section 1 letter f) of the GDPR)
• in the remaining scope, the data will be processed on the basis of the Candidate's consent expressed by an express confirmatory action consisting in including this data in the application (Article 6 section 1 letter a) of the GDPR)
• data may also be processed on the basis of the Controller's legitimate interest, after the completion of the recruitment process in order to establish, pursue or defend against possible claims related to it (Article 6 section 1 letter f) of the GDPR)

If you consent to processing your personal data for the purpose of future recruitment possibilities, the data will be processed on the basis of your consent to such processing (Article 6 section 1 letter a) of the GDPR). 

V. What is the purpose of our processing of your data? 

Your information is always treated as confidential and used solely for the purpose of assessing the application submitted by you, providing you with information on the recruitment procedures, processing the application to carry out the recruitment process and taking steps at your request prior to entering into a contract including on the basis of your consent for future recruitment processes. We may also process your personal data for internal reporting and development reasons- this is necessary due to the Controllers’ legitimate interests in tracking recruitment and managing an external and internal talent pool, which do not override your interests or fundamental rights and freedoms requiring the protection of personal data. 

VI. What are the consequences of non-provision of your data? 

Your provision of data is voluntary, yet necessary to participate in the recruitment process, to meet further legal requirements and/or to enter into a contract with us. Failure to provide us with the required information will render participation in the recruitment process and/or sending information related to the future recruitment process impossible. 

VII. How long do we store your personal data? 

Vention stores your personal data for as long as this is required under applicable laws or for as long as the processing of personal data is necessary for the purposes set forth in this Information Clause. Vention keeps the data provided by you via the recruitment service for the duration of the recruitment process solely for the purpose of carrying out the process and in order to comply with the data recording requirements imposed by applicable laws. If you want us to keep your documents in our job applicant database for a longer period (including for future recruitment processes and sending recruitment newsletter), your consent will be required, and your personal data will be processed for the period of 2 years. 

VIII. Who will receive your personal data? 

Vention makes personal data available to third parties in line with applicable laws. Your personal data is processed solely for the purposes referred to herein or for closely related purposes. Once you have given the relevant consent, personal data may be used for future recruitment processes and also be transferred to affiliated entities within the Vention Group network. Vention can share candidate’s personal data with: 

 

• other entities in the Vention Group, including entities established in countries outside the European Economic Area
• service providers, customers
• entities located in third countries, outside the territory of the European Economic Area

It is possible that the law of a country to which data is transferred provides for a level of data protection which differs from the GDPR regulations, however, this will be a country for which the European Commission has issued an adequacy decision, or an entity bound by an agreement ensuring the same level of protection as the one prevailing at Vention.  Vention will ensure that the transfer of personal data to a third country is carried out in accordance with the requirements of the GDPR. You can at any time request details about the entities to which your personal data has been made available and the scope of information about you which has been made available, by contacting us by sending a message to privacy.lt@ventionteams.com .Entities located in third countries will ensure the security of personal data at a level not lower than the level of safeguards applied by Vention. 

IX. What are your rights? 

As a job applicant and subject of personal data, you have the right to: 

 

• request access to your personal data held by Vention
• request rectification and erasure of the data
• request limitation of its processing
• data portability
• object to its processing
• obtain a copy of data transferred to third countries

In order to exercise the rights, please contact us by sending a message to: privacy.lt@ventionteams.com. If data is processed on the basis of your consent, you may withdraw your consent at any time. If you withdraw the consent, this will not affect the lawfulness of processing based on consent before its withdrawal. If the personal data processing violates the privacy and information security regulations, you also have the right to lodge a complaint with a supervisory authority, that is the State Data Protection Inspectorate. These rights may be limited if the fulfilment of your request would disclose data about another person or if you have asked us to remove the information which is required by law or where retaining the information is necessary on the grounds of legitimate interests of the Controller. 

X. Security of your personal data 

Vention uses technical, physical and organizational security measures to prevent the risk of loss, misuse, disclosure or modification of information provided by you, as well as the risk of unauthorized access to such information.

XII. Consent 

The job applicant, using a specific recruitment service to take part in the recruitment conducted by Vention, agrees to the processing of his/her personal data by performing an explicit confirming action (e.g. by sending his/her CV and/or by completing the form with his/her personal data). The provision of data in this way via the recruitment service is tantamount to consent to the collection, processing, use, storage and transfer of the user’s personal data by Vention in a manner specified in the Information Clause. By sending the application documents, you also agree to the electronic handling of all issues relating to the recruitment, application, identity verification and onboarding process.  

 

IF YOU DO NOT CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL DATA AS INDICATED ABOVE, YOU CANNOT TAKE PART IN THE RECRUITMENT.  

Informacinis pranešimas kandidatams į darbuotojus dėl asmens duomenų tvarkymo

 

Pasirinkite šalį, kurioje dalyvaujate įdarbinimo (savanoriškos praktikos) programoje: Lietuva. Vention Development UAB, kurios registruota buveinė yra Vilniuje, privalo saugoti jai pateiktus ar patikėtus asmens duomenis. Asmens duomenis tvarkome vadovaudamiesi Lietuvos Respublikoje galiojančiais įstatymais. Šiame informaciniame pranešime yra paaiškinama, kas mes esame, kokius asmens duomenis tvarkome, kokiais tikslais ir kiek laiko juos saugome, kaip galite susipažinti su duomenimis, kaip juos saugome, kur duomenys gali būti perduodami ir kokios yra Jūsų teisės. 

 

I. Kas yra Jūsų asmens duomenų valdytojas? 

Vention Development UAB, kurios buveinė yra adresu Lvivo g. 25-104, Vilniuje (LT-09320),  Lietuvos Respublika, yra asmens duomenų Valdytojas, kaip apibrėžta 2016 m. balandžio 27 d. Europos Parlamento ir Tarybos reglamente (ES) 2016/679 dėl fizinių asmenų apsaugos tvarkant jų asmens duomenis ir dėl laisvo tokių duomenų judėjimo, ir kuriuo panaikinama Direktyva 95/46/EB (Bendrasis duomenų apsaugos reglamentas, toliau – BDAR), toliau – „Vention“ ir kartu su ja susijusiomis įmonėmis, kaip „Vention Group“. II. Kokius asmens duomenis tvarkome? 

Vention gali gauti iš jūsų informaciją, susijusią su jūsų paraiška dėl įdarbinimo ar bendradarbiavimo su Vention. Mes tvarkome duomenis, būtinus tinkamam įdarbinimo procesui, kuriame Jūs dalyvaujate, įgyvendinimui ir būtinus darbo sutarčiai / civilinei sutarčiai su Jumis sudaryti, tokius kaip: 

 

• vardas (-ai) ir pavardė
• gimimo data
• kandidato nurodyti kontaktiniai duomenys
• išsilavinimas
• profesinė kvalifikacija
• darbo patirtis

Užsieniečių atveju - taip pat duomenys, kurių reikalaujama pagal įstatymus ir kurie gaunami iš dokumentų, reikalingų įdarbinimo teisėtumui patikrinti arba įdarbinimo įteisinimo procedūrai atlikti. Taip pat galime tvarkyti ir kitus Jūsų mums pateiktus duomenis, pvz. nuotrauka. Savo iniciatyva galite mums pateikti papildomos informacijos (CV, motyvaciniame laiške ar panašiame dokumente). Tokiu atveju Jūsų asmens duomenis Vention tvarkys darbo (savanoriškos praktikos) sutarties sudarymo tikslais. Todėl, jei norite mums pateikti dokumentus su papildoma informacija, suprantame, kad pateikdami paraišką Jūs sutinkate, kad Vention tvarkytų Jūsų asmens duomenis. Jūs neprivalote mums pateikti papildomos informacijos. Jeigu nenorite, kad tvarkytume daugiau Jūsų asmens duomenų, nei reikalauja įstatymas, prašome tokios informacijos į siunčiamą CV neįtraukti. 

III. Kaip gaunami Jūsų asmens duomenys? 

Įdarbinimo proceso metu renkame savo kandidatų asmens duomenis. Asmens duomenys gaunami dviem būdais: 

 

• tiesiogiai iš kandidatų (įskaitant Vention svetainę, su darbu susijusias svetaines, tokias kaip Linkedin.com, kitas interneto platformas ir kt.) arba
• iš trečiųjų šalių, visų pirma: a) Iš Vention Group išteklių; b) iš Vention darbuotojų ir rangovų, gavus išankstinį jūsų sutikimą, kaip dalį mūsų vidinės ar išorinės rekomendacijų programos; c) iš viešųjų duomenų šaltinių, tokių kaip Linkedin; d) iš įdarbinimo įmonių, darbo agentūrų, tarpininkų ir paslaugų teikėjų (jei taikoma)

IV. Kokiu pagrindu tvarkome Jūsų asmens duomenis? 

Jūsų asmens duomenys bus tvarkomi su įdarbinimu į pasirinktas pareigas susijusiais tikslais: 

 

• kandidatų įsidarbinti pagal darbo sutartį Darbo kodekse nurodytos apimties atveju ir imtis veiksmų Jūsų prašymu prieš sudarant darbo sutartį pagal BDAR 6 straipsnio 1 dalies b) punktą
• kandidatų pagal civilinės teisės sutartį atveju, tiek, kiek būtina imtis veiksmų duomenų subjekto prašymu prieš sudarant sutartį, pagal BDAR 6 straipsnio 1 dalies b) punktą
• užsieniečio įdarbinimo atveju – be aukščiau nurodytų tikslų, papildomai siekiant patikrinti įdarbinimo teisėtumą, vadovaujantis BDAR 6 straipsnio 1 dalies c) punktu arba legalizavimo procedūros atlikimui, vadovaujantis BDAR 6 straipsnio 1 dalies b) punktu
• jei Jūsų duomenis gavome iš viešai prieinamų šaltinių - kad galėtume atlikti ir suderinti įdarbinimo procesą Jums dalyvaujant (tuomet Jūsų duomenų tvarkymo teisinis pagrindas yra teisėtas interesas, kurio siekiama remiantis BDAR 6 straipsnio 1 dalies f) punktu)
• likusioje apimtyje duomenys bus tvarkomi remiantis Kandidato sutikimu, išreikštu aiškiais patvirtinamaisiais veiksmais, kuriuos sudaro šių duomenų įtraukimas į paraišką (BDAR 6 straipsnio 1 dalies a) punktas)
• duomenys taip pat gali būti tvarkomi Duomenų valdytojo teisėto intereso pagrindu, pasibaigus įdarbinimo procesui, siekiant nustatyti, vykdyti ar apsiginti nuo galimų su tuo susijusių pretenzijų (BDAR 6 straipsnio 1 dalies f) punktas)

Jei sutinkate, kad Jūsų asmens duomenys būtų tvarkomi galimam įdarbinimui ateityje, toliau duomenys bus tvarkomi remiantis Jūsų sutikimu tokiam duomenų tvarkymui (BDAR 6 straipsnio 1 dalies a) punktas). 

V. Koks yra Jūsų duomenų tvarkymo tikslas? 

Jūsų informacija visada laikoma konfidencialia ir naudojama tik Jūsų pateiktai paraiškai įvertinti, informacijai apie įdarbinimo procedūras suteikti, paraiškai apdoroti, kad būtų galima vykdyti įdarbinimo procesą ir imtis veiksmų Jūsų prašymu prieš sudarant sutartį, įskaitant Jūsų sutikimą dėl būsimų įdarbinimo procesų. Taip pat galime tvarkyti Jūsų asmens duomenis vidaus ataskaitų teikimo ir tobulinimo tikslais – tai būtina dėl Valdytojo teisėtų interesų, susijusių su įdarbinimo stebėjimu ir išorės bei vidaus talentų fondo valdymu, kurie nėra svarbesni už Jūsų interesus ar pagrindines teises ir laisves, reikalaujančias asmens duomenų apsaugos. 

VI. Kokios yra Jūsų duomenų nepateikimo pasekmės? 

Jūsų duomenų teikimas yra savanoriškas, tačiau būtinas norint dalyvauti įdarbinimo procese, atitikti teisinius reikalavimus ir (arba) sudaryti su mumis sutartį. Nepateikus mums reikiamos informacijos, dalyvavimas įdarbinimo procese ir (arba) su būsimu įdarbinimo procesu susijusios informacijos siuntimas taps neįmanomas. 

VII. Kiek laiko saugome Jūsų asmens duomenis? 

Vention saugos Jūsų asmens duomenis tol, kol to reikalauja taikomi įstatymai arba tol, kol asmens duomenis reikia tvarkyti šiame Informaciniame pranešime nurodytais tikslais. Vention saugos įdarbinimo metu Jūsų pateiktus duomenis visą atrankos proceso laiką tik šio proceso vykdymo tikslais ir siekdama laikytis taikomuose įstatymuose nustatytų duomenų registravimo reikalavimų. Jei norite, kad Jūsų dokumentus savo kandidatų į darbą duomenų bazėje saugotume ilgesnį laiką (įskaitant būsimus įdarbinimo procesus ir įdarbinimo naujienlaiškio siuntimą), bus reikalingas Jūsų sutikimas, ir gavus Jūsų sutikimą, asmens duomenys bus tvarkomi 2 metus. 

VIII. Kas gaus Jūsų asmens duomenis? 

Vention teikia asmens duomenis trečiosioms šalims pagal galiojančius įstatymus. Jūsų asmens duomenys tvarkomi tik čia nurodytais arba glaudžiai susijusiais tikslais. Gavus atitinkamą sutikimą, asmens duomenys gali būti naudojami būsimiems įdarbinimo procesams ir taip pat perduodami susijusiems subjektams Vention Group tinkle. Vention gali dalytis Kandidato asmens duomenimis su: 

 

• kitais Vention Group subjektais, įskaitant subjektus, įsteigtus šalyse, nepriklausančiose Europos ekonominei erdvei
• paslaugų teikėjais, klientais
• subjektais, esančiais trečiosiose šalyse, už Europos ekonominės erdvės ribų

Gali būti, kad šalies, į kurią perduodami duomenys, įstatymai numato kitokį duomenų apsaugos lygį nei BDAR nuostatos, tačiau tai bus šalis, dėl kurios Europos Komisija yra priėmusi sprendimą dėl tinkamumo, arba subjektas, kuriam privalomas susitarimas, užtikrinantis tokį patį apsaugos lygį, koks galioja Vention. Vention užtikrins, kad asmens duomenų perdavimas į trečiąją šalį būtų vykdomas pagal BDAR reikalavimus. Galite bet kada paprašyti informacijos apie subjektus, kuriems buvo pateikti Jūsų asmens duomenys, ir informacijos apie Jus, kuri buvo pateikta, apimtį, kreipdamiesi į mus žinute adresu privacy.lt@ventionteams.com. Trečiosiose šalyse esantys subjektai užtikrins asmens duomenų saugumą ne žemesniu nei Vention taikomų apsaugos priemonių lygiu. 

IX. Kokios Jūsų teisės? 

Kaip kandidatas į darbuotojus ir asmens duomenų subjektas, Jūs turite teisę: 

 

• reikalauti leisti susipažinti su Vention saugomais Jūsų asmens duomenimis
• reikalauti ištaisyti ir ištrinti duomenis
• reikalauti apriboti jų tvarkymą
• į duomenų perkeliamumą
• prieštarauti dėl jų tvarkymo
• gauti trečiosioms šalims perduotų duomenų kopiją

Norėdami pasinaudoti teisėmis, susisiekite su mumis siųsdami žinutę adresu: privacy.lt@ventionteams.com. Jei duomenys tvarkomi Jūsų sutikimo pagrindu, savo sutikimą galite bet kada atšaukti. Jūsų sutikimo atšaukimas neturės įtakos duomenų tvarkymo teisėtumui, kuris yra pagrįstas gautu sutikimu iki jo atšaukimo. Jei asmens duomenų tvarkymas pažeidžia privatumo ir informacijos saugumo taisykles, turite teisę pateikti skundą taip pat ir priežiūros institucijai, tai yra Valstybinei duomenų apsaugos inspekcijai. Šios teisės gali būti ribojamos, jeigu vykdant Jūsų prašymą būtų atskleisti duomenys apie kitą asmenį arba jeigu Jūs paprašėte mūsų pašalinti informaciją, kurios išsaugojimas yra privalomas pagal įstatymą arba kai informaciją saugoti būtina dėl teisėtų Valdytojo interesų. 

X. Jūsų asmens duomenų saugumas 

Vention naudoja technines, fizines ir organizacines saugumo priemones, kad išvengtų Jūsų pateiktos informacijos praradimo, netinkamo naudojimo, atskleidimo ar pakeitimo rizikos, taip pat neteisėtos prieigos prie tokios informacijos rizikos. 

XI. Kaip galite susisiekti su mumis? 

Atsiradus bet kokiems nesklandumams, problemoms ar skundų atveju, kurie susiję su Jūsų asmens duomenų tvarkymu, prašome susisiekite su mumis: privacy.lt@ventionteams.com.  

XII. Sutikimas 

Kandidatas, naudodamasis konkrečia įdarbinimo paslauga, norintis dalyvauti Vention vykdomoje atrankoje, atlikdamas aiškų patvirtinimo veiksmą (pvz., išsiųsdamas savo CV ir (arba) užpildydamas formą su savo asmens duomenimis), sutinka, kad būtų tvarkomi jo asmens duomenys. Duomenų teikimas per įdarbinimo tarnybą prilygsta sutikimui, kad Vention rinktų, tvarkytų, naudotų, saugotų ir perduotų vartotojo asmens duomenis Informacinio pranešimo nurodytu būdu. Siųsdami paraiškos dokumentus taip pat sutinkate, kad visi su įdarbinimo, paraiškos teikimo, tapatybės tikrinimo ir įdarbinimo procesu susiję klausimai būtų tvarkomi elektroniniu būdu.
